Wish organization protected by release
Give Kids the World, a nonprofit that provides free storybook vacations to seriously ill children and their families at its resort village in Florida, is protected from liability to a parent injured during a gift trip by the form of release the parents signed before the trip, an appellate court in Florida has held. A mother was injured when a wheelchair lift collapsed and she sued for damages. The parents had signed a release, releasing the company “for any liability whatsoever in connection with the preparation, execution and fulfillment” of the wish “including, but not limited to, damages or losses or injuries encountered in connection with transportation, food, lodging, medical concerns...
