Texas Foundation Can’t Sue Alabama Grantee in Texas
Court says university did not “purposefully avail” itself of the privilege of conducting activities within Texas
A private foundation in Texas may not sue the University of Alabama in a Texas court for breach of contract for a scholarship program being operated in Alabama, an appellate court in Texas has held. It has reversed a trial court decision allowing the case to proceed. The University of Alabama originally inquired about a First Scholars Program funded by the Suder Foundation to support first generation college students. In 2009, a university employee called about the program and sent a letter expressing interest in January 2010.
