Statutory allegations state claim under FLSA
A federal District Court in Florida has held that bare allegations of facts setting forth jurisdiction over a Fair Labor Standards Act claim are sufficient to defeat a motion to dismiss brought by the defendant. A job developer for Unidad of Miami Beach claimed he was not compensated at overtime rates for work done in excess of 40 hours a week. He alleged that he individually, and other employees of Unidad, handled, sold or worked with materials that were moved or produced in interstate commerce and that the employer had annual gross revenues in excess of $500,000.
