RFRA protects Archdiocesan Cemetery Trust from bankruptcy

The Religious Freedom Restoration Act protects the Cemetery Perpetual Care Trust of the Milwaukee Archdiocese from claims of creditors in the Archdiocese bankruptcy, the federal District Court in Wisconsin has ruled. It has reversed a Bankruptcy Court ruling that rejected the Archbishop’s request for protection from claims of the Unsecured Creditors Committee primarily seeking recovery for claims of clerical abuse victims. The Archdiocese has operated and maintained Catholic cemeteries and mausoleums in Milwaukee since 1857, in about 1000 acres in which more than 500,000 individuals are interred.
