The Supreme Court of Oregon has affirmed the 90-day suspension of a lawyer who advised an employee of a medical marijuana clinic during her effort to take over the clinic because she thought it was being badly managed. In giving advice to the employee, who had been asked to leave the clinic but was not sure whether she had been fired, the attorney searched the state’s corporate records and found that the corporation had been “administratively dissolved” for failing to fire required reports. (The state statute allows reinstatement if requested within five years.) In fact, the corporation had been reinstated, but the certificate issued by the state was incorrect.
