Health cost sharing program is not insurance

The Supreme Court of Idaho has reversed a trial court and held that a voluntary program in which individuals contributed monthly to an escrow account from which contributors could claim funds to pay their healthcare costs was not an insurance program. The Court held that the program did not shift the risk of payment from the individuals to the program. The state Insurance Department had determined that it was an insurance program because it shifted the requirement for payments onto the escrow fund and ultimately its sponsor. The sponsor claimed, however, that it was “a nationwide faith based membership of individuals who share in each other’s medical needs by bearing the burden of others.”...
