The Sixth Circuit Court of Appeals has affirmed the termination of an employee of a nonprofit healthcare provider who refused to delete emails containing confidential health information that she had forwarded to her personal account. She claimed that she sent the emails to preserve evidence in an age discrimination case filed by a former worker. The employee worked closely with the organization’s CFO and CEO. In 2011 the CFO was fired and sued for age discrimination.
