Although the U.S. Supreme Court has expanded the scope of the “ministerial exemption” that exempts churches and religious schools from employment discrimination suits by certain “ministerial” employees ( See Nonprofit Issues ® Vol. XXX, No.3 ), the 10 th Circuit Court of Appeals has rejected an appeal from the denial of summary judgment in favor of a Christian school claiming the plaintiff was covered by the exception. The Court said it had no jurisdiction to hear the “interlocutory” appeal because it was not an appeal from a final judgment.
