Court refuses to value nonprofit in divorce distribution

The Supreme Court of Georgia has affirmed a trial court’s refusal to value a nonprofit sports organization in an equitable division of assets proceeding during divorce. The Court agreed that the wife had not shown the value of the business prior to marriage. The wife claimed that a “closely-held” nonprofit corporation that sponsored and held weekend sports tournaments for children in metropolitan Atlanta was subject to equitable property division. The trial court held that she had failed to show it was subject to division or that its appreciation in value, if any, was the result of her efforts during the marriage.
