Challenge by intestate heirs is rejected when decedent’s intention was clear
A claim by 26 intestate heirs seeking to invalidate a $1.45 million family educational trust, which would make the money available to them, has been denied by an appellate court in Louisiana. The Court has held that the language of the will was sufficient to establish the trust. ( Succession of Henderson, Ct. of App., LA, No. 50,475-CA, 2/24/16. ) Delbert Henderson, a successful electrical contractor, died in January 2011. His wife had predeceased him and they had no children. His will left $1.45 “to be used to establish the Henderson Academic Scholarship Fund” for $2000 a year scholarships to Louisiana Tech for “members of my family,” including family members of his brothers and sisters...
