Code violations do not prevent real estate exemption
Technical violations of a town’s building or fire code do not prevent a Jewish synagogue and summer camp from qualifying for charitable real estate tax exemption, an Appellate Court in New York has held. Oorah, Inc., a New Jersey nonprofit corporation, fought for several years with the Town of Jefferson in New York to obtain real estate tax exemption for several properties in Schoharie County. The properties were used for a synagogue, residential units, office space, athletic fields and nature trails and a summer camp for underprivileged children. The town Board of Assessment denied exemption in 2012 for failure to provide adequate information, which was largely reversed in a court appeal...
