Investigations 101
As an executive or a board member of a nonprofit, the last thing you want to see come across your desk is a complaint of wrongdoing. What do you do? Who do you tell? How do you respond? Does the content of the complaint dictate the appropriate response? What will be the long-term effects?
Do you have policies in place to answer those questions?
Whether the complaint alleges financial wrongdoing, or sexual misconduct or some other whistleblower concern, two attorneys with extensive experience in performing and advising on investigations will discuss the appropriate steps you need to take to initially respond to the complaint. They will explain how to conduct a proper investigation to avoid missteps and minimize impact on the organization, both internally and externally. They will talk about when and how to employ outside counsel to advise or perform the work. Ultimately, the goal is to avoid these complaints arising in the first place, and, as such, will also advise on what safeguards and policies to implement in order to help prevent — or at least identify — the issues early before they lead to a complaint.
Lawyers and other professional advisers to nonprofits who only occasionally deal with these issues may also want to pick up tips from attorneys who deal with investigations almost every day and to ask specific questions on how to deal with difficult situations.
The discussion will be led by Ashley Lynam, the first woman Co-Chair of the Philadelphia law firm of Montgomery McCracken, and Kacie Kergides, a member of the firm’s Sexual Misconduct Liability Practice Group. Nonprofit Issues® editor Don Kramer and Tish Mogan, Standards for Excellence Consultant for the Pennsylvania Association of Nonprofit Organizations, will moderate and facilitate the program.
