A federal District Court in Illinois has refused to dismiss a claim for breach of fiduciary duty brought by the owner of a high-speed car loaned to the Museum of Science and Industry in Chicago. The owner claims that the car has been damaged while in the custody of the museum. Although neither party cited a case holding that there is a fiduciary relationship between the person who loans items for exhibit and a museum, the Court said that membership in the American Alliance of Museums and use of the Alliance’s National Standards and Best Practices for U.S. Museums were “sufficient to allege that the Museum owed a fiduciary duty to Plaintiff while it possessed and displayed his car” and...
