Can a U.S. corporation funding a religious school in a foreign country get 501(c)(3) status?

Your Legal Questions Answered

Can a U.S. corporation funding a religious school in a foreign country get 501(c)(3) status?

Can a U.S. corporation whose main objective is to fund a religious orphanage/school in a foreign country get 501(c)(3) status and collect donations from American donors that are tax deductible to the American donor?

Usually yes. The traditional way to give deductibility to U.S. donors for gifts that eventually go to foreign charities is to create a “friends of” the foreign charity organization in the U.S. (See Ready Reference Page: “Foreign Grants Require Special Considerations.”)

The new Form 990 tax information return includes a new Schedule F to report on grantmaking activities outside the U.S.
